TRANSPORTATION AGREEMENT

COASTAL LIMOUSINE OF CHARLESTON, LLC

This Services Agreement (the “Agreement”), dated as of , is between Coastal Limousine of Charleston, LLC, a South Carolina limited liability (the “Coastal”) and undersigned Student and their Parent (collectively, the “Passenger”).

WHEREAS, the Passenger, along with other Students and Parents of Christ Our King (“School”) wishes to retain the services of Coastal to transport Passenger to and from School, and Coastal Agrees to provide those services under the terms below.

NOW, THEREFORE, it is hereby agreed as follows:

 

  1. Monthly Fee. The monthly fee will be drafted automatically on the first of each month.
  1. Term. Coastal shall provide services on a ten month basis throughout the 2023- 2024 School Year.
  1. Cancellation/Refunds. Cancellation for any reason other than under School Cancellation shall require 60 days’ notice by either party. Any payments already made shall be nonrefundable.
  1. Compliance with Rules. Passenger agrees to comply with rules below or any rules otherwise presented by Coastal. Coastal may amend or alter these rules from time to time.
  • Riders will always obey the bus driver.
  • No eating on the bus, please.
  • No drinking on the bus, water is allowed.
  • No chewing gum on the bus.
  • Use kind words.
  • No pens or pencils.
  • Always stay seated especially when the bus is in motion.
  1. Parent Financial Liability. By agreement here, undersigned Parent or Guardian assumes full financial liability for any damage to the vehicle caused by Passenger beyond reasonable wear and tear including but not limited to damage caused by coloring, spillage, stains, gum, scissors, and similar damaging activity.
  1. Complaint Process. Should you have concerns or complains, please direct those to your Person of Contact. Coastal will communicate through the Person of Contact to assist in resolving any issues.
  1. Video and Audio Monitoring/Recording. For the safety of all individuals, Coastal monitors activity inside the bus through video monitoring and recording. Passenger consents to such monitoring and recording.
  1. Assumption of Risk. Passenger freely and voluntarily chooses to assume all the risks inherent in a ride in a Coastal vehicle, including but not limited to risks of negligent conduct of others, equipment, or vehicle malfunction.
  1. Release of Liability. Passenger, his/her heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives hereby releases, holds harmless, and forever discharges Coastal Limousine Of Charleston, LLC or “Coastal,” or any officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns, whether acting on the behalf of Coastal Limousine of Charleston, or “Coastal,” from any and all liability, claims, demands, and causes of action of any nature whatsoever, whether in contract or in tort or under any other legal theory, arising out of Passenger’s participation in the bus ride. Coastal shall not be responsible for any consequential damages arising pursuant to fulfilling the services of this agreement. Further, should Coastal be found liable under any legal theory, damages shall not exceed that amount of the payment by Passenger.
  1. Force Majeure. Coastal shall not be liable hereunder for any failure or delay in the performance of its obligations under this Agreement if such failure or delay is on account of causes beyond its reasonable control, including civil commotion, war, fires, floods, accident, earthquakes, inclement weather, pandemic, telecommunications line failures, electrical outages, network failures, governmental regulations or controls, casualty, strikes or labor disputes, terrorism, acts of God, or other similar or different occurrences beyond Coastal’s reasonable control. Coastal shall use reasonable efforts to notify the other Party of the occurrence of such an event. Should a Party experience a force majeure event, it shall take reasonable measures to mitigate any impact that such event has on its performance of this Agreement and shall take all reasonable steps to perform despite such event.
  1. Indemnification. Passenger, his/her heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives agree to indemnify, defend, save, and hold harmless Coastal Limousine Of Charleston, LLC, Coastal, or any officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns, whether acting on the behalf of Coastal Limousine of Charleston, LLC or “Coastal”, with regards to any and all losses, claims, actions, and proceedings of every nature whatsoever which may be presented or initiated by any person or entity, arising directly or indirectly out of Passenger’s participation in the bus ride.
  1. Attorney’s Fees. If either Party incurs any legal fees associated with the enforcement of this Agreement or any rights under this Agreement, the prevailing Party shall be entitled to recover its reasonable attorney’s fees and any court, arbitration, mediation, or other litigation expenses from the other Party.
  1. Agreement. By signing this electronic agreement, a contract forms between Coastal and the customer for hire of the transportation service and pertains specifically to the performance by the customer and their guests in the Coastal vehicle(s)

 

Payment Section:

I understand that submission of this form authorizes Coastal Limousine of Charleston (CL) to charge the listed credit/debit card or ACH Bank Account for the amount specified in the section labeled amount due.
